Bingo! Terms of Service

Last updated: October 4, 2026

Effective date: January 4, 2027. Existing accounts will be notified at least 30 days before this date.

These Terms of Service (the "Terms") are a legal agreement between you and Bingo! LLC ("Bingo," "we," "us," or "our"). They apply when you use our website at https://bingopetcare.app, the Bingo app, and any related services (together, the "Platform").

These Terms are written mainly for Clients (pet parents) and for anyone else who visits or uses the Platform. Businesses and Bingo Sitters who offer care on Bingo also agree to separate agreements (Section 1.3), and those agreements add to these Terms.

Please read these Terms carefully. By creating an account, booking care, or otherwise using the Platform, you agree to them. If you don't agree, please don't use the Platform.

The short version

This box summarizes the Terms. It does not replace them. If this box and the full Terms differ, the full Terms control.

  • Bingo is a platform, not a pet care company. Pet care booked through Bingo is provided by independent pet care businesses and independent Bingo Sitters, not by Bingo.
  • You must be 18 or older to have an account.
  • Clients pay no Bingo fee. You pay your caregiver's price. Tips always go 100% to your caregiver.
  • Your caregiver sets the price and the cancellation policy. You'll see the policy before you ask to cancel. Bingo does not set those rules.
  • Payments go through Bingo's payment processor, PayCosmos. Bingo then pays your caregiver.
  • Caregivers on Bingo must carry insurance. Bingo does not yet run background checks. We plan to start them before the public marketplace opens.
  • Keep your pet's information accurate and current. That includes vaccinations, health, behavior, and home access details.
  • Be honest and respectful in reviews and messages, and keep bookings and payments on the Platform.
  • Bingo's responsibility is limited. Bingo does not supervise care and is not responsible for what Providers or other Users do. Your remedies for problems with care are against the Provider and its insurance, and Bingo's own liability is limited as Section 15 explains.
  • New Jersey law applies.

1. Who we are and what these Terms cover

1.1 About Bingo

Bingo! LLC is a Delaware limited liability company. Our mailing address is 315 E Linden St, Moorestown, NJ 08057. Bingo operates only in the United States, and the Platform is intended for US residents and for pet care at US service locations.

1.2 Key terms

These words have the following meanings in these Terms and in our Privacy Policy:

  • Client: a person who uses the Platform to request or book pet care for their own Pets. A Client's Family is the household profile they set up, including any Household Members they add.
  • Pet: an animal listed on a Client's Family profile.
  • Business (or Business Subscriber): a pet care business that subscribes to a paid Bingo business plan and uses the Platform to run its business and serve its own clients. Business Personnel are a Business's owners, managers, employees, contractors, and trainees.
  • Bingo Sitter (or Independent Bingo Sitter): an individual, independent pet care provider who subscribes to a Bingo sitter plan. A Bingo Sitter may also work with a Business as a contractor.
  • Provider (or caregiver): a Business, its Business Personnel, or a Bingo Sitter who provides pet care.
  • Pet Care Services: the pet care a Provider offers, such as walks, drop-in visits, pet sitting, and boarding.
  • Request: a Client's request for Pet Care Services, sent through the Platform.
  • Booking: a Request that a Provider has accepted (and, where needed, that the Client has approved), creating one or more scheduled visits.
  • The Bingo Route: Bingo's feature that sends a Request to eligible Providers in a set order (Section 5.2).
  • Specific Provider booking: a Request sent to one Provider the Client chooses (Section 5.3).
  • Meet & Greet: a short introductory meeting between a Client and a caregiver before care begins (Section 5.6).
  • User: anyone who uses the Platform, including Clients, Providers, and visitors.

1.3 Other documents that apply

These Terms work together with:

  • our Privacy Policy (https://bingopetcare.app/privacy), which explains how we handle personal information;
  • our Fee Schedule, which lists Bingo's plan prices and fees;
  • the Emergency Veterinary Care Authorization, if you sign one for your Pet. Bingo's form is a template used for independent Bingo Sitters. A Business may instead use its own emergency forms, which it uploads for its clients to sign and fill out;
  • for Bingo Sitters, the Independent Sitter Agreement; and
  • for Businesses, the Business Subscription Agreement and Data Processing Addendum.

Some of these documents are not published yet. We will link each one here when it is.

2. Bingo is a platform, not your caregiver

2.1 What Bingo does

Bingo provides software. The Platform helps Clients find, request, book, pay for, and communicate with Providers, and it helps Businesses and Bingo Sitters run their pet care work.

2.2 What Bingo does not do

Bingo does not provide Pet Care Services. Bingo does not walk, feed, sit, board, groom, train, transport, or treat any animal. Pet Care Services are provided by Businesses and Bingo Sitters, who are independent of Bingo.

  • Providers are independent businesses and individuals. They are not Bingo's employees, agents, partners, joint venturers, or representatives, and they cannot make promises or agreements on Bingo's behalf.
  • Bingo does not supervise, direct, or control how a Provider performs care, and Bingo is not present during visits. Platform features such as scheduling, check-in, visit tracking, report cards, and messaging help Providers and Clients communicate and keep records. They do not mean Bingo manages the care.
  • Each Provider decides which Requests to accept, sets its own prices, sets its own cancellation and refund policies, and is solely responsible for the care it provides, for its own staff and contractors, for its own conduct, and for following the laws, licenses, and permits that apply to its work.
  • When you book with a Business, your agreement for care is with that Business. When you book with an independent Bingo Sitter, your agreement for care is with that Sitter.

2.3 Bingo as a Business's software

When you are a client of a Business that uses Bingo, the Business uses the Platform as its own business software. That Business's own policies (such as its cancellation, refund, deposit, and service rules) apply to your Bookings with it. Bingo shows those policies and records what happens under them, but does not write them or decide disputes under them, except as described in Section 8.4.

2.4 Veterinary care

Bingo is not a veterinary provider and does not give veterinary advice. Any pet health information on the Platform (such as first-aid guides) is for general information only and is not a substitute for a veterinarian. Veterinarian features are not available to the public yet.

2.5 Third-party services

The Platform relies on, and may link to, services run by other companies, such as our payment processor (PayCosmos and its gateway, linked2pay), Sign in with Google, mapping and email providers, and outside parties such as insurers, veterinary clinics, and pet transport services. Those services are provided by those companies under their own terms and privacy policies. Bingo does not control them and, to the fullest extent permitted by applicable law, is not responsible for their acts, omissions, availability, or content.

3. Eligibility

To create an account, you must:

  • be at least 18 years old (or the age of majority where you live, if that is higher);
  • be able to form a binding contract;
  • live in the United States, and book care only for US service locations; and
  • not have been removed from the Platform by Bingo before, unless we have agreed in writing that you may return.

A Household Member under 18 may be listed on a Family profile as a contact only, by a parent or legal guardian. They cannot have their own login.

4. Your account

4.1 Creating an account

You can sign up with an email address and password or with Sign in with Google. You agree to give us accurate, current, and complete information and to keep it up to date.

4.2 Accepting these Terms

When you sign up, we may ask you to tick a box agreeing to these Terms and the Privacy Policy. We record which version you accepted and when. When we publish a new version, we may ask you to accept it before you continue (Section 19).

4.3 Keeping your account secure

You are responsible for keeping your login details safe and for activity on your account. Tell us right away at hello@bingopetcare.app if you think someone has used your account without permission. For security, each sign-in lasts at most 8 hours. After that, you are signed out and need to sign in again.

4.4 Family members

You may add Household Members to your Family profile and choose which of them may book or authorize care. You are responsible for the people you add and for making sure you have their permission to share their information with us.

4.5 Closing your account

You can ask to delete your account in your account settings. When you do, your account is closed right away and is scheduled for deletion after 7 days. You can cancel the deletion by signing back in during those 7 days. Some records may be kept after deletion, as the Privacy Policy explains (for example, for legal, tax, safety, or dispute reasons). Closing your account does not cancel amounts you already owe for care.

5. How booking works

5.1 Making a Request

To request care, you choose your Pets, the service location, dates, times, and the service. Before you send a Request, you choose how to send it: The Bingo Route or a Specific Provider.

Services you can request are either:

  • Bingo standard services, which Bingo defines and which Providers can choose to offer at their own prices; or
  • a Provider's custom services, which you can request only by booking that Provider directly.

5.2 The Bingo Route

When you choose The Bingo Route, your Request is offered to Providers one at a time, in this order:

  1. Your own Business first (only in one case). If you own a Business account on Bingo and that Business has at least one active staff member, your Request goes to your own Business first.
  2. Your preferred caregivers. Next, your Request goes to your preferred caregivers (up to five), in the order you ranked them.
  3. Nearby matching. If none of them accepts, your Request is offered to other Providers within about 15 miles of the service location who offer the Bingo standard service you chose, starting with the nearest and then by rating.
  4. No match. If no one accepts, the Request is cancelled and we tell you. You are not charged for a Request no one accepted.

If you are new and have no preferred caregivers yet, your Request starts at nearby matching.

Response times. Each caregiver has 24 hours to respond, and a Business has 48 hours. If the visit starts within 48 hours, each has 2 hours. A Request never waits past the visit itself.

Providers you exclude. If you have told us not to send Requests to a particular Provider, we won't.

The public marketplace is not open at launch. Until it opens, nearby matching is how Bingo finds caregivers beyond your preferred list. In some areas there may be few or no nearby caregivers yet.

5.3 Specific Provider booking

When you choose a Specific Provider, you choose one caregiver from your preferred caregivers, and your Request goes only to that Provider. If they decline or don't respond in time, we ask you what to do next: send the Request on through The Bingo Route, or cancel it.

5.4 Prices and estimates

  • Providers set their own prices. Bingo does not set or control them.
  • Estimates. Before you send a Request, we may show an estimated price. If you have preferred caregivers, the estimate is a range based on their prices. If you don't, or we can't calculate a range, we tell you that the price depends on which caregiver accepts.
  • An estimate is not a promise. The final price is the price of the Provider who accepts your Request, including any add-ons or surcharges the Provider has chosen to turn on in their own account (for example, holiday or last-minute surcharges). Bingo does not add any surcharge of its own.
  • Price approval. If the accepting Provider's price is not covered by an estimate you already saw, we will ask you to approve the price before the Booking is confirmed. If you don't approve it, the Booking is not confirmed.
  • Local price ranges. We may show typical local price ranges for Bingo standard services. These are general information only and are not a quote from any Provider.

5.5 Confirmation

A Booking is confirmed when a Provider accepts your Request and any needed price approval is complete. A Meet & Greet is never required to confirm a Booking. You'll see the status of every Request and Booking in the app.

For a Booking with an independent Bingo Sitter, only the booked Sitter may perform the visit. Sitters may not send a helper or hand the visit to someone else.

5.6 Meet & Greets

  • A Meet & Greet is recommended, not required, before a new caregiver cares for your Pets for the first time. You can book a first visit directly.
  • A Provider may suggest a Meet & Greet. If you'd like one, you can book it, usually from the caregiver's open times. For a Booking with an independent Bingo Sitter, either you or the Sitter can schedule it and mark it complete.
  • Meet & Greet fees are set by the Provider. Some Providers offer them free; others charge a fee. If a Provider sets a fee, you'll be asked to approve it first.
  • A Meet & Greet is a chance for both sides to decide whether to go ahead. Either side may decide not to continue after it.

5.7 Changes and rescheduling

You can ask to change or reschedule a Booking in the app. Changes are subject to the Provider's agreement and its policies.

6. Payments

6.1 Clients pay no Bingo fee

Bingo does not charge Clients any fee to use the Platform or to book care. You pay the Provider's price for the care you book (plus any tip you choose to give). Bingo is paid by Providers through their Bingo plans, as shown in our Fee Schedule.

6.2 How payment works

  • Payments for care are processed by our payment processor, PayCosmos (with its gateway, linked2pay). Your full card number is entered with PayCosmos and is never stored by Bingo.
  • You pay invoices for your Bookings in the app, by card or bank account (ACH) where offered. You may save a payment method so invoices can be paid with it.
  • Your payment goes into Bingo's PayCosmos merchant account. Bingo then pays the Provider. Bingo collects your payment only as a limited payment collection agent for the Provider, so once your payment succeeds, your payment obligation to the Provider for that amount is met.
  • Before launch: Bingo is launching on January 4, 2027. Until then, only clients of Sileo Pet Services and Bingo test accounts can book care, so only those payments go through Bingo's account.

6.3 Invoices, deposits, and estimates

  • Providers bill you by invoice, which you can view in the app and receive by email.
  • A Provider may require a deposit when a Booking is accepted, under its own policy. You will see the deposit before you book.
  • If you paid toward an estimate or deposit, that amount is credited to your final invoice so you are not billed twice.
  • Estimates when you book: a Provider may email you an estimate each time a visit is booked. The Provider decides whether it does this for all of its clients or only for some clients, and you can turn these emails off in your Settings ("Email me an estimate when a visit is booked"). Your estimates are always shown in the app either way.
  • Visit bundles: a Business may sell or give you a bundle of visits of one service (for example, a Social Club Passport). One visit comes off the bundle when a visit of that service is completed, and that visit shows on your invoice as $0 ("Covered by bundle"). A visit cancelled before it is completed does not use one. When no visits are left, or the bundle has expired, visits are billed at the normal price. You can see how many visits are left in the app. Bundles are not offered for vacation care (overnights, boarding, or house sitting). Refunds and expiration are set by the Business.
  • Tax: Bingo does not currently add sales tax to invoices.

6.4 Processing fees

Bingo does not charge Clients processing fees. However, a Provider on a paid Bingo plan may choose to pass some or all card or bank processing fees on to its clients. If a Provider does this, a "Processing fee" line is shown on your invoice and payment screen before you pay. It is never charged on your tip.

6.5 Tips

You may add a tip when you pay. Tips always go 100% to your caregiver. Bingo never takes a commission on tips, and Bingo pays the processing fee on the tip portion, so the full tip reaches your caregiver. For a Business, the tip is paid to the Business, which passes it to the caregiver under its own arrangements.

6.6 Emergency veterinary costs

If your Pet needs emergency veterinary care, the clinic bills you directly. Bingo does not charge your payment method for veterinary costs and does not pay clinics.

6.7 Failed payments and chargebacks

If a payment fails, we may ask you to try again or use another payment method, and the Provider may pause future Bookings until the balance is paid. If you think a charge is wrong, please contact the Provider or us first, before disputing it with your bank, so we can try to fix it quickly.

6.8 Referral credits

Bingo may offer Client referral credits. Credits shown in your account currently cannot be spent, have no cash value, and may change or end. We will tell you before they can be used.

6.9 Off-platform payments

Please pay for Bookings made through Bingo only through the Platform. Paying a Provider in cash or off the Platform for a Booking made on Bingo removes the payment records, protections, and support Bingo can offer, and may lead to the Provider's or your account being suspended.

7. Cancellations

7.1 Each Provider sets its own cancellation policy

  • Businesses set their own cancellation, deposit, and refund policies for their clients.
  • Independent Bingo Sitters set their own cancellation policies for their own Bookings.
  • If an independent Bingo Sitter has not set a cancellation policy, Bingo's default sitter cancellation policy applies:
    • more than 24 hours before the visit: free;
    • within 24 hours of the visit: 25% of the visit price;
    • within 12 hours of the visit: 50% of the visit price;
    • within 2 hours of the visit: 75% of the visit price.

The policy that applies to a visit is the one in effect when you booked it. If a Provider later changes its policy, the change does not affect visits you already booked.

7.2 How a Client cancels

  • You cancel by sending a cancellation request in the app. Before you send it, we show you the Provider's policy for that visit and the fee it calls for, if any.
  • The Provider (for a Business, its owner or authorized staff) confirms or declines your request, and decides any cancellation fee under its policy. The Provider may reduce or waive the fee. A Business's managers may apply or waive the owner's cancellation fee for a single visit. They apply the Business's policy; they cannot change it.
  • You can withdraw a cancellation request until the Provider answers it.
  • Once a visit has started, you can't cancel it in the app. Please message your Provider.
  • For a multi-night stay, you can ask to cancel the whole remaining stay at once. The Provider's stay rules decide the fee.

7.3 When a Provider cancels

A Provider can cancel a visit, but must give a reason, which you will see. When a Provider (a Business or an independent Bingo Sitter) cancels a visit, any deposit you paid for that visit is always returned to you in full, and the Provider may never charge you a cancellation fee.

7.4 Requests no one accepts

If no Provider accepts a Request, it is cancelled and you are not charged (Section 5.2).

8. Refunds

8.1 Refunds follow the Provider's policy

Whether you get a refund for a Booking depends on the Provider's own refund and cancellation policy. Bingo does not promise refunds for Pet Care Services.

8.2 Who can issue a refund

  • For a Business Booking, refunds can be issued by the Business's owner or by a Bingo administrator.
  • Independent Bingo Sitters cannot issue refunds themselves. If you and your Sitter agree on a refund, or you believe one is owed, contact us at hello@bingopetcare.app and a Bingo administrator will review it.
  • Refunds go back to the original card. Refunds of bank (ACH) payments may need to be handled separately.

8.3 Deposits

What happens to a deposit when you cancel depends on the Provider's deposit rule, which you see before you book. Depending on that rule, a deposit may be applied to the cancellation fee, with the rest refunded or turned into account credit with that Provider, or it may be non-refundable.

8.4 When Bingo may step in

Bingo may, but is not required to, review a dispute between a Client and a Provider and may issue a refund where we reasonably believe it is fair, for example after a safety incident, a visit that didn't happen, or a payment error. A Bingo administrator's refund decision does not limit your other rights against the Provider.

9. Your responsibilities as a pet owner

You agree to:

  1. Give accurate, complete Pet information and keep it current, including species, breed, age, weight, feeding and walking instructions, medications, medical conditions, allergies, and behavior.
  2. Disclose any history of biting, attacking, aggression, or escaping, and any triggers or handling needs, before care begins and whenever it changes.
  3. Keep your Pets' vaccinations current as required by law and by your Provider's policy, and upload vaccination records when asked. Bingo sets no vaccination requirements of its own. Each Provider sets its own.
  4. Give safe, working home access. Provide accurate entry instructions, keys, lockbox or alarm codes, and parking or building details, and update them when they change. Entry details are shown only to the people the Privacy Policy describes.
  5. Tell us about cameras and recording devices. Disclose the cameras, doorbells, and audio devices at each service location, as the app asks.
  6. Keep a safe environment for caregivers, including controlling other animals and hazards at the service location.
  7. Name emergency contacts and a veterinarian, and keep them reachable during visits.
  8. Emergencies. If your Pet becomes ill or injured during care, the caregiver will try to reach you and your emergency contacts. If you have signed an Emergency Veterinary Care Authorization (or your Business's own emergency form), the caregiver may arrange care within the limits you set. You are responsible for all veterinary costs. Caregivers do not pay veterinary deposits or transport costs for you; the hospital or transport service bills you directly. If you authorized transport and your caregiver drives your Pet, the caregiver logs the miles and you are billed at the IRS standard mileage rate on your next invoice.
  9. Own or be authorized to arrange care for each Pet you book for.

If you give inaccurate or incomplete information, a Provider may decline or end care, and you may be responsible for resulting harm or costs.

10. Caregiver screening and insurance

10.1 Insurance

Bingo requires each independent Bingo Sitter to carry their own pet care business insurance before they can be booked through Bingo. Sitters buy their policy from an insurer of their choice and pay the insurer directly. A Sitter's insurance must:

  • be approved by a Bingo administrator, based on proof the Sitter uploads;
  • list Bingo! LLC as an additional insured;
  • cover at least $1,000,000 per incident; and
  • include home boarding coverage if Pets stay in the Sitter's home.

Insurance is the Sitter's own policy, not Bingo's. Bingo is not an insurer, does not sell insurance, and does not decide claims. Claims are made with the Sitter's insurer.

Businesses must meet the same insurance requirement: at least $1,000,000 per incident, including care, custody, and control coverage, with Bingo! LLC listed as an additional insured, and proof approved by a Bingo administrator.

10.2 Background checks

Bingo does not currently run background checks on Bingo Sitters or anyone else. We plan to require background checks for independent Bingo Sitters before the public Bingo marketplace opens. When they begin, any violent criminal record or animal cruelty record will disqualify a Sitter from being booked through Bingo. Until then, insurance is the only screening requirement Bingo applies. Businesses may screen their own staff under their own practices.

10.3 What Bingo does not promise

Bingo does not endorse any Provider. Bingo does not guarantee the identity, background, qualifications, experience, licensing, quality, safety, honesty, or suitability of any Provider or User, or that any Provider's insurance is in force or will cover a particular loss (Section 15.3). Any screening Bingo does, now or in the future (including insurance review and, once they begin, background checks), is limited, depends on information from Providers and outside vendors, and may be incomplete or out of date. Reviews and ratings are the opinions of other Users, not Bingo's. Please use your own judgment, including through a Meet & Greet, before you book.

11. Reviews and your content

11.1 Leaving a review

  • You can review a caregiver or Business only after a completed visit with them. You can leave one review per visit.
  • Reviews and the reviewer's name are visible to signed-in Users.
  • Reviews must be honest and based on your own experience. Don't post reviews that are false, abusive, discriminatory, or that include private information (such as addresses, entry codes, or phone numbers).

11.2 Replies and reports

  • A Business's owner or manager may post one public reply to a review of that Business.
  • A Business can report a review it believes breaks these rules. A report flags the review for Bingo to look at; Businesses cannot hide or delete reviews.
  • Only Bingo decides whether to remove or hide a review. We may remove reviews that break these Terms or the law.

11.3 Your content

"Your content" means anything you add to the Platform, such as Pet profiles, photos, documents, messages, and reviews. You keep ownership of your content. You give Bingo a non-exclusive, worldwide, royalty-free license to host, store, copy, display, and share your content only as needed to run, improve, and protect the Platform and as the Privacy Policy describes. You confirm you have the right to share your content.

11.4 Photos of your Pets on social media

A Provider may post photos of your Pet on social media only if you give separate, optional permission. You can limit or withdraw that permission.

11.5 Copyright complaints

If you believe content on the Platform infringes your copyright, send a notice to our designated agent at privacy@bingopetcare.app or by mail to Bingo! LLC, 315 E Linden St, Moorestown, NJ 08057, with the information the Digital Millennium Copyright Act requires.

12. Messaging

  • Clients and Providers communicate through in-app messaging, and Bingo sends email notifications about your account and Bookings. Bingo does not offer in-app or masked calling, and does not currently send text messages or push notifications.
  • Bingo may review messages for safety and to enforce the Terms.
  • Keep messages respectful and about the care. Don't use messaging for spam, harassment, or marketing unrelated to your Bookings.
  • Businesses and independent Bingo Sitters may send announcements to their own clients. You can opt out in Settings or with the unsubscribe link in any announcement.

13. Acceptable use

When you use the Platform, you agree not to:

  1. break any law, or use the Platform for anything illegal or unsafe;
  2. give false information, impersonate anyone, or create an account for someone else without permission;
  3. harass, threaten, discriminate against, or abuse anyone, including caregivers, Clients, and Bingo staff;
  4. mistreat, neglect, or put any animal at risk;
  5. arrange or pay for a Booking made through Bingo off the Platform to avoid Bingo's systems;
  6. post false or misleading reviews, or offer or accept anything in exchange for a review;
  7. share another person's private information (such as addresses, entry codes, or contact details) without permission;
  8. collect data from the Platform by scraping, bots, or other automated means;
  9. try to get around security, access accounts or data you're not allowed to see, or interfere with the Platform's operation;
  10. upload viruses or harmful code; or
  11. copy, sell, or resell the Platform, or use it to build a competing service.

14. Privacy

Our Privacy Policy (https://bingopetcare.app/privacy) explains how we collect, use, share, and protect personal information, including location during active visits, home access details, and your privacy rights. By using the Platform, you understand that your information will be handled as the Privacy Policy describes.

15. Assumption of risk, release, disclaimers, and limitation of liability

In this Section and in Section 16, the "Bingo Parties" means Bingo! LLC and its owners, members, managers, officers, employees, and agents.

15.1 Your choices and the risks of pet care

You decide whether to use the Platform, which Provider to book, and what instructions, access, and information to give them. Pet care carries risks that no one can fully remove, even when everyone is careful. Animals can act unpredictably. A Pet may be injured, become ill, bite or be bitten, escape, get lost, or die, and property may be damaged, lost, or stolen, including keys, lockbox or alarm codes, and other access details. To the fullest extent permitted by applicable law, you choose to accept these risks when you book Pet Care Services through the Platform, and you agree that they are risks shared between you and your Provider, not risks of the Bingo Parties.

15.2 Release of the Bingo Parties

Bingo does not provide Pet Care Services and does not supervise Providers, so Bingo cannot be responsible for what Providers and other Users do. To the fullest extent permitted by applicable law, you release the Bingo Parties from all claims, demands, losses, damages, and liabilities of every kind, known or unknown, that arise out of or relate to:

  • (a) the acts or omissions of any Provider, Business Personnel, Household Member, or other User, whether online or offline;
  • (b) any Pet Care Services, Meet & Greet, or other meeting or interaction arranged through the Platform; or
  • (c) any dispute between you and a Provider or another User,

including claims for injury to, illness of, loss of, or death of any Pet or other animal; damage to, loss of, or theft of property; personal injury; and emotional distress.

You understand that this release covers claims you may not know about or suspect today, and you waive any law that would otherwise limit a general release to known claims. If you live in California, this includes California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

This release does not apply to any claim that cannot be released under applicable law (Section 15.6), and it does not affect your rights against the Provider.

15.3 Provider insurance and Bingo's help

  • A Provider's insurance belongs to the Provider. Listing Bingo! LLC as an additional insured protects Bingo. It does not make Bingo responsible for paying any claim against a Provider, and it does not mean the policy will cover your loss.
  • When a Bingo administrator approves a Provider's proof of insurance, Bingo checks only the document the Provider uploaded. Bingo does not confirm that the policy is valid or in force, or that it will pay any claim.
  • If Bingo chooses to help with a problem, for example by reviewing a dispute, sharing records, or issuing a refund under Section 8.4, that help is voluntary. It is not an admission of responsibility, and it does not oblige Bingo to help in the same way again.

15.4 Disclaimer of warranties

THE PLATFORM AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE BINGO PARTIES DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE PARAGRAPH ABOVE, BINGO DOES NOT WARRANT OR GUARANTEE: (A) THE QUALITY, SAFETY, TIMELINESS, OR LEGALITY OF ANY PET CARE SERVICES; (B) THE IDENTITY, BACKGROUND, QUALIFICATIONS, LICENSING, INSURANCE, HONESTY, OR CONDUCT OF ANY PROVIDER OR USER; (C) THE ACCURACY OF ANY PROFILE, REVIEW, RATING, PRICE ESTIMATE, LOCATION, OR OTHER INFORMATION ON THE PLATFORM; (D) THAT ANY REQUEST WILL BE ACCEPTED OR THAT ANY VISIT WILL HAPPEN; OR (E) THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL CODE. ANY PET HEALTH INFORMATION ON THE PLATFORM IS GENERAL INFORMATION ONLY (SECTION 2.4).

15.5 Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • (a) THE BINGO PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, OR ANY PET CARE SERVICES, EVEN IF BINGO HAS BEEN TOLD THAT SUCH DAMAGES ARE POSSIBLE.
  • (b) THE BINGO PARTIES WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE ACTS OR OMISSIONS OF ANY PROVIDER, BUSINESS PERSONNEL, OR OTHER USER, OR FROM ANY PET CARE SERVICES, INCLUDING INJURY TO, ILLNESS OF, LOSS OF, OR DEATH OF ANY PET, PROPERTY DAMAGE, THEFT, OR PERSONAL INJURY.
  • (c) THE BINGO PARTIES' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID TO BINGO IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED US DOLLARS ($100). AMOUNTS YOU PAY FOR PET CARE SERVICES, DEPOSITS, AND TIPS ARE PAID TO PROVIDERS, EVEN WHEN BINGO COLLECTS THEM UNDER SECTION 6.2, AND ARE NOT FEES PAID TO BINGO. BECAUSE CLIENTS PAY BINGO NO FEES, FOR MOST CLIENTS THIS LIMIT IS $100.

These limits apply to every kind of claim, whether based on contract, warranty, tort (including negligence), strict liability, statute, or any other legal theory, and even if a limited remedy fails of its essential purpose. They are an essential part of the bargain between you and Bingo, and Bingo offers the Platform to Clients without charge in reliance on them.

15.6 What these limits do not take away

New Jersey residents. If you are a New Jersey resident, the assumption of risk, release, disclaimers, exclusions, liability limits, and indemnity in Sections 15 and 16 apply to you only to the extent New Jersey law permits. Nothing in these Terms limits or waives any right you have under the New Jersey Consumer Fraud Act or the Truth in Consumer Contract, Warranty and Notice Act.

Residents of other states. If you live outside New Jersey, those same Sections apply to you to the extent the law of your state permits.

For everyone. Nothing in these Terms limits or excludes: (a) liability for a Bingo Party's fraud, gross negligence, or willful misconduct; (b) any right you have as a consumer that cannot be waived or limited by contract, including under New Jersey law; or (c) any other liability that cannot be limited or excluded under applicable law. If a court decides that any part of this Section 15 is unenforceable, that part will be limited only as much as needed, and the rest of this Section will still apply.

16. Indemnity

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Bingo Parties from and against all claims, demands, losses, damages, liabilities, fines, costs, and expenses (including reasonable attorneys' fees), including claims brought by Providers and other Users, that arise out of or relate to:

  • (a) your breach of these Terms;
  • (b) your content;
  • (c) inaccurate or incomplete information you gave about your Pets, home, or service locations, including any failure to disclose aggression, bite history, escape history, or health conditions;
  • (d) the behavior of your Pets, including a bite, attack, or injury to a Provider, another person, or another animal, or damage to property;
  • (e) conditions at your service location, or the acts of your Household Members or other people you allow there;
  • (f) your dealings or disputes with any Provider or other User; or
  • (g) your violation of any law or of anyone else's rights.

Bingo may choose to control the defense of any claim covered by this Section, with counsel of its choice, and you will cooperate. You may not settle a covered claim in a way that imposes an obligation or admission on a Bingo Party without Bingo's written consent.

17. Disputes and governing law

17.1 Talk to us first

Most problems can be solved quickly. Before starting any formal claim, please email hello@bingopetcare.app with a description of the issue, and give us 30 days to try to resolve it.

17.2 Disputes with Providers and other Users

Your agreement for care is between you and your Provider, and any dispute about care, conduct, property, or payment for care is between you and that Provider (or the other User involved). Bingo is not a party to those agreements or disputes and has no obligation to investigate, mediate, or resolve them. Bingo may choose to help, for example by sharing records or reviewing a refund (Section 8.4), but any help is voluntary (Section 15.3). The release in Section 15.2 applies to these disputes.

17.3 Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules, and by applicable US federal law.

17.4 How disputes are resolved

Either side may bring an eligible claim in small claims court.

18. Suspension and termination

  • You can stop using the Platform and close your account at any time (Section 4.5).
  • Bingo may suspend, limit, or close your account, or remove content, if you break these Terms, if we reasonably believe it's needed to protect Pets, Users, or the Platform, or if the law requires it. Where it is safe and lawful, we will tell you why and give you a chance to respond.
  • Visits already confirmed may be cancelled if an account is closed. Amounts you owe for care already given stay due.
  • Sections that by their nature should continue after termination will continue, including Sections 2, 6 (for amounts owed), 8, 10.3, 11.3, 15, 16, 17, and 20.

19. Changes

19.1 Changes to these Terms

We may update these Terms. The "Last updated" date at the top shows when they last changed.

  • Material changes: we will give at least 30 days' notice by email and in the app before a material change takes effect, and may ask you to accept the new Terms before you continue.
  • Faster changes: changes required for legal, security, fraud-prevention, safety, or payment-processing reasons may take effect sooner, with notice as soon as reasonably practicable.
  • Minor changes, such as formatting, clarifications, or corrections that don't reduce your rights, take effect when posted.

If you keep using the Platform after a change takes effect, you accept it. If you don't agree, please stop using the Platform and close your account.

19.2 Changes to the Platform

We may add, change, or remove features. Some features described in these Terms may not be available in every area or at launch (for example, the public marketplace and veterinarian features).

Before Bingo opens for bookings (launching January 4, 2027). Until then, only clients of Sileo Pet Services, our pilot business, and Bingo test accounts can book care. Anyone else may create an account and set up their profile and pets, and is added to our waitlist; new independent sitters and pet-care businesses join the waitlist instead of applying.

20. General

  • Entire agreement: these Terms, with the documents in Section 1.3, are the whole agreement between you and Bingo about the Platform.
  • Severability: if any part of these Terms can't be enforced, the rest stays in effect.
  • No waiver: if we don't enforce a part of these Terms right away, we can still enforce it later.
  • Assignment: you may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets, with notice to you.
  • Electronic communications: you agree that we may send notices and records electronically, and that electronic acceptance (such as ticking a box) is as valid as a signature.
  • Events outside our control: Bingo isn't responsible for any delay or failure to perform caused by events beyond its reasonable control, such as natural disasters, severe weather, fire, flood, epidemics, power or internet outages, failures of third-party services (including payment processors and hosting providers), labor disputes, war, civil unrest, or government action.
